Nothing on this page replaces the specific written agreement, proposal, statement of work, membership agreement, coaching agreement, or engagement letter governing a paid ForgePoint engagement. When a separate written agreement applies, that agreement controls in the event of a conflict.

1. Our Commitment to Privacy

ForgePoint respects the privacy of the business owners, leaders, clients, prospects, subscribers, partners, and visitors who interact with us.

We collect and use personal information for legitimate business purposes, including providing services, responding to inquiries, managing client relationships, delivering communications, improving our website and programs, and operating ForgePoint.

We do not promise that every interaction with the internet or any digital system is completely secure. However, we take reasonable measures to protect the information entrusted to us and work with established technology and service providers to operate our business.

Payment card information may be processed by third-party payment providers. ForgePoint does not necessarily receive or store complete payment card information.

Website and Technical Information: Depending on the technology used on our website, we or our service providers may collect IP address, browser type, device information, referring pages, pages visited, approximate location, dates and times of visits, interactions with emails or website content, cookies, or similar technologies.

We may collect information when you submit a website form; subscribe to Field Notes or another email list; schedule a call; purchase a product or service; apply for coaching, consulting, membership, or partnership; participate in a Business X-Ray or other diagnostic process; complete an intake or assessment; attend a meeting, event, workshop, or program; communicate with ForgePoint; use our website; or voluntarily provide information to us in another manner.

4. How We Use Information

We may use information to deliver products and services; respond to inquiries; evaluate whether a prospect and ForgePoint are a good fit; prepare for coaching or consulting engagements; communicate with clients and subscribers; deliver Field Notes and other requested communications; process transactions and administer accounts; improve programs, content, systems, and customer experience; analyze website and marketing performance; prevent fraud or misuse; maintain appropriate business and financial records; protect our rights and interests; satisfy legal or regulatory requirements; and carry out other purposes disclosed when information is collected.

5. Email Communications

When you subscribe to Field Notes or another ForgePoint communication, we may send you educational content, business insights, company updates, offers, invitations, and other communications. You may unsubscribe from marketing emails using the unsubscribe mechanism included in those communications.

Some communications related to an active transaction or client relationship may be transactional or operational in nature and may continue when necessary to provide services, manage an account, fulfill an agreement, or communicate important information about an existing relationship.

6. How We May Share Information

We may share information with service providers who help us operate the business, including providers involved in website hosting, customer relationship management, email delivery, payment processing, accounting, scheduling, video conferencing, analytics, document management, automation, client communication, and other business operations.

ForgePoint does not sell personal information in the ordinary sense of exchanging an individual's personal information for monetary payment.

Business owners may share sensitive operational, financial, personnel, leadership, or strategic information with ForgePoint during a coaching or consulting relationship. Our handling of confidential client information may also be governed by a separate coaching agreement, consulting agreement, engagement letter, nondisclosure agreement, or other written contract.

Website submission alone does not create a confidential professional relationship equivalent to an attorney-client, accountant-client, medical, or other legally privileged relationship. You should not send highly sensitive information through an unsecured public website form unless specifically requested.

8. Data Retention

We may retain personal and business information for as long as reasonably necessary to provide services; manage client relationships; maintain business records; comply with tax, accounting, contractual, and legal obligations; resolve disputes; and enforce agreements. Terms of Use

1. Acceptance of These Terms

By accessing or using the ForgePoint website, content, forms, resources, downloads, programs, communities, or digital properties, you agree to these Terms of Use. Do not use the website or ForgePoint content if you do not agree with these terms.

2. Educational and Business Content

ForgePoint provides information related to business strategy, profitability, pricing, referrals, average transaction value, customer frequency, leadership, operations, systems, accountability, organizational development, business growth, and owner independence.

The website contains general information and education. It does not create a coaching or consulting engagement merely because you read, watch, download, or interact with content. A paid coaching, consulting, diagnostic, or advisory relationship begins only according to the applicable agreement and engagement process.

3. Intellectual Property

Unless otherwise stated, the content and materials made available by ForgePoint are owned by ForgePoint or used with permission. This includes written content, videos, audio, graphics, presentations, assessments, worksheets, workbooks, diagnostic tools, frameworks, methodologies, process maps, templates, training materials, program curriculum, branding, and other proprietary material.

ForgePoint materials are provided for the authorized user's personal or internal business use unless a written agreement expressly allows another use. You may not, without written permission, reproduce or republish ForgePoint materials; sell or sublicense them; distribute them publicly; upload paid materials into shared databases or public AI systems; use them to create a competing product or service; teach proprietary ForgePoint materials as your own; remove attribution or proprietary notices; or commercially exploit ForgePoint intellectual property.

Participation in a program or purchase of a service does not transfer ownership of ForgePoint intellectual property.

4. User Conduct

You agree not to use the website or ForgePoint platforms to violate applicable law; interfere with website operations; gain unauthorized access to systems or accounts; transmit malware or harmful code; scrape or harvest information without authorization; impersonate another person; infringe intellectual property rights; harass participants or team members; distribute confidential information without authority; or misuse community, membership, or program access. We may restrict or terminate access for misuse.

5. Purchases and Paid Services

Pricing, payment terms, cancellation policies, refund terms, scope of services, duration, and other engagement-specific terms may be established in checkout terms, offer descriptions, proposals, coaching agreements, consulting agreements, membership agreements, statements of work, or other written agreements.

Those specific terms are incorporated into the relationship and control over inconsistent general website language. Unless otherwise stated in the applicable agreement, purchasing a program or service does not guarantee any particular financial, operational, leadership, or business outcome.

6. Third-Party Tools and Services

ForgePoint may recommend, discuss, demonstrate, integrate, or link to third-party software, platforms, vendors, contractors, lenders, insurance providers, accounting professionals, legal professionals, marketing providers, or other resources.

A recommendation or introduction does not make ForgePoint responsible for a third party's services, products, conduct, availability, pricing, performance, security, or advice. You are responsible for your own evaluation and contractual relationship with third parties.

7. Affiliate Relationships

From time to time, ForgePoint may receive compensation, referral fees, affiliate commissions, discounts, or other benefits when someone purchases a third-party product or service through a ForgePoint link or referral. Where required, material relationships will be disclosed.

8. No Unauthorized Reliance

You are responsible for evaluating information before making business decisions. Do not make significant financial, legal, tax, employment, insurance, investment, medical, or regulatory decisions solely from general website content or educational material. Seek qualified professional advice when appropriate.

9. Website Availability

We work to maintain useful and accurate content, but we do not guarantee that the website will always be available; all information will always be current; every error will be corrected immediately; content is suitable for every business; or third-party systems will operate without interruption. These general website Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any additional dispute-resolution procedures applicable to a paid engagement may be established in the specific written agreement governing that engagement.

Coaching & Consulting Disclaimer

1. Nature of ForgePoint Services

ForgePoint provides business coaching, consulting, diagnostics, education, advisory support, strategic facilitation, operational guidance, and related services.

Depending on the engagement, ForgePoint may help clients identify business constraints; interpret business information; establish priorities; improve pricing and profitability; improve customer frequency, referrals, and average ticket; create processes and accountability systems; clarify organizational roles; strengthen leadership rhythms; design implementation plans; evaluate strategic options; and improve execution.

The exact scope of a paid engagement is determined by the applicable agreement.

2. Coaching and Consulting Are Collaborative

ForgePoint does not operate your company merely because we provide coaching or consulting.

Unless a written Operating Partner or other engagement agreement expressly assigns specific implementation authority or responsibilities, the client retains responsibility for business decisions; hiring and termination; pricing decisions; contracts; spending; debt; taxes; payroll; compliance; customer commitments; legal decisions; financial decisions; and implementation.

Our role is to help improve clarity, structure, decision quality, execution, and accountability—not to remove the owner's responsibility for the company.

3. Not Legal Advice

ForgePoint is not a law firm and does not provide legal representation or legal advice. Discussions of business entities, contracts, employment practices, intellectual property, regulatory compliance, liability, taxes, ownership arrangements, or similar subjects are general business discussions unless a qualified attorney independently provides legal services. Consult a licensed attorney for legal advice.

4. Not Tax or Accounting Advice

ForgePoint is not acting as your certified public accountant, tax preparer, auditor, or financial reporting professional unless a separately engaged licensed professional expressly provides those services. 6. No Fiduciary Relationship

Unless a written agreement expressly states otherwise and applicable law permits it, coaching and consulting services do not create a fiduciary relationship. The client retains final authority and responsibility for decisions.

7. No Substitute for Independent Professional Advice

Business issues often overlap. A strategic recommendation may have legal, tax, accounting, insurance, employment, financing, or regulatory implications. Clients are responsible for engaging appropriately qualified professionals before implementing decisions where specialized professional advice is needed.

Results Disclaimer

1. No Guaranteed Results

ForgePoint does not guarantee increased revenue; increased profit; reduced expenses; higher prices; more customers; more referrals; improved customer retention; successful hiring; improved employee performance; successful delegation; owner independence; business valuation; sale of a company; or any other specific result.

We provide frameworks, strategy, coaching, consulting, systems, accountability, and implementation support. You and your team still have to execute.

2. Business Results Vary

Results depend on factors that may include starting financial condition, market demand, industry, geography, competitive environment, pricing, reputation, leadership ability, team performance, implementation quality, consistency, available capital, capacity, economic conditions, client decisions, and factors outside anyone's control.
